By accessing or using MemeBazi AI ("Service"), operated by MemeBazi AI, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

MemeBazi AI is an AI-powered face swap entertainment platform that allows users to create personalized meme content by swapping their face onto pre-approved Bollywood movie template videos. The Service uses artificial intelligence technology to generate synthetic media for entertainment purposes only.

3. Eligibility

• You must be at least 18 years of age to use this Service.
• By using the Service, you represent and warrant that you are at least 18 years old.
• If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. User Consent & Representations

By uploading a photo and using the Service, you represent and warrant that:

• The photo you upload is your own likeness or you have explicit written consent from the person depicted.
• You will not upload photos of minors (persons under 18 years of age).
• You will not use the Service for any illegal, defamatory, harassing, or harmful purposes.
• You understand the content is AI-generated synthetic media and will not misrepresent it as real footage.
• You will not use generated content to impersonate, defraud, or deceive others.

5. Prohibited Uses

You agree NOT to use the Service to:

• Create non-consensual intimate imagery or pornographic content
• Create content that defames, harasses, or threatens any person
• Impersonate public figures, celebrities, or any third party for fraudulent purposes
• Create political misinformation or election-related deepfakes
• Generate content that promotes violence, hatred, or discrimination
• Violate any applicable local, state, national, or international law
• Infringe upon intellectual property rights of others

6. AI-Generated Content Disclosure

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, all content generated through our Service is clearly marked as AI-generated synthetic media. Users must not remove or obscure this disclosure when sharing content.

7. Intellectual Property

• You retain rights to the original photos you upload.
• Generated content is licensed to you for personal, non-commercial use only.
• Template videos and the Service itself remain the property of MemeBazi AI.
• You grant MemeBazi AI a limited license to process your uploaded images solely for providing the Service.
• We use Bollywood movie clips under fair use for transformative, educational, and parody purposes.

8. Payment & Refund Policy

• Payments are processed securely through Razorpay.
• Pricing varies by tier: HD Fun (₹49/3 videos), Perfect (₹199/3 videos), Ultimate Trial (₹159/1 video), Ultimate Pack (₹499/3 videos).
• Automatic Refund: If AI generation fails or times out, your payment will be automatically refunded within 5-7 business days.
• No Refund: Successfully generated content is non-refundable as the service has been rendered.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMEBAZI AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount paid by you for the specific transaction giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless MemeBazi AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Content Moderation & Takedown

MemeBazi AI reserves the right to remove any content that violates these Terms or applicable law. We comply with lawful takedown requests under the IT Act 2000 and IT Rules 2021. To report violating content, contact our Grievance Officer.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
